Introduction
GoConnect Australia Pty Ltd (ABN 86 090 146 213) (GoConnect) is committed to the protection of your personal information. By personal information, we mean information or an opinion about a person whose identity is apparent or can reasonably be ascertained (as defined in the Privacy Act 1988 (Cth)).
We are bound by the National Privacy Principles (NPP) set out in the Privacy Act 1988 (Cth) as amended by the Privacy Amendment (Private Sector) Act 2000. The information set out below is largely a summary of our obligations under the NPP.
This Privacy Policy contains the following important information regarding the personal information collected by GoConnect in connection with a subscription to the Direct Assist software ("the Software"):
- Collection of your personal information;
- How GoConnect uses your personal information;
- Disclosure of your information;
- Security of your information;
- How to access, correct or update your information;
- What else you should know about privacy; and
- How to contact GoConnect.
We believe that this Privacy Policy will address any potential concerns you may have about how personal information that you provide to GoConnect is collected, held, used, corrected, disclosed and transferred. You can obtain more information on request about the way we manage the personal information we hold. If you seek any further information please contact us in one of the ways set out below.
2. Collection of your personal information:
GoConnect will collect your personal information to enable it to process your purchase of a registered Software Key to activate the Software ("Software Key"). The types of personal information that will be collected from you may include details such as your name, address, e-mail address, mobile phone number, and credit card details.
We will only collect personal information from you that is necessary for one or more of our functions or activities. We will only collect personal information from you by lawful and fair means, such as when you purchase a Software Key.
At or before the time we collect personal information from you, we will take reasonable steps to inform you why we are collecting that personal information, who else we might disclose that personal information to and what will happen if you do not provide personal information to us.
Where reasonable and practicable, we will only collect personal information about you, from you.
Wherever it is lawful and practicable, we will give you the option of not providing personal information when entering into transactions with us. However, certain information is essential for GoConnect to be able to accurately identify who is using the Software. If you do not provide this information GoConnect will not be able to permit you to purchase a Software Key.
3. Use and disclosure of your personal information:
The personal information that you provide to GoConnect during the subscription process is used predominantly for identification/billing purposes. Other information gathered from your use of the Software enables GoConnect to provide better-personalised software that is tailored to your needs. GoConnect aggregates the data that is gathered when you use the Software for analytical purposes. Personally identifiable characteristics are removed and the user remains anonymous, unless you have given prior specific consent for GoConnect to recognise your personalised usage.
In order to provide you with the Software, we may provide access to your personal information to third parties with whom we have a business relationship, for example to third party suppliers and contractors. You accept that not all recipients of your information may have privacy policies equivalent to GoConnect's and you consent to the disclosure of your personal information for those purposes.
GoConnect will not use your personal information or data for a purpose other than these purposes (specified above) unless:
- you would reasonably expect us to use the personal information for that other purpose; and
- that other purpose is related to the purposes specified above, or any other purpose communicated to you at the time of collection. For example, sending you e-mails providing essential information about the Software.
GoConnect may also use your personal information for the purpose of direct marketing. GoConnect may only use your personal information or data for the purpose of direct marketing in relation to promotional activities where it is impracticable for us to obtain your prior express consent. GoConnect will provide an express opportunity when we first contact you to decline receiving any further marketing communications from GoConnect, via an opt-out mechanism. GoConnect will only send emails to you if you have elected to receive such emails or if they are in response to an email we have received from you.
If GoConnect wishes to use any of this personal information, information or data for any purpose other than those specified above, we will not do so unless we have your express consent to do so, or where:
- there are reasonable grounds to believe that disclosure is necessary to prevent a threat to life or health;
- GoConnect suspects that unlawful activity is or has been engaged in and uses the personal information, information or data to investigate the suspected unlawful activity; or
- the use is authorised by law or reasonably necessary to enforce the law. These uses may include where GoConnect is required to provide information in response to subpoenas or warrants or other legal or regulatory processes.
4. Security of your information that you may send to or receive from using the Software:
GoConnect will take reasonable steps to ensure that all information collected, used or disclosed is protected from misuse or loss and is stored in a secure environment to be accessed only by authorised persons. Transmissions sent to or from GoConnect through the Software are routinely monitored for quality control and systems administration.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. While GoConnect strives to protect your personal information from misuse, loss and unauthorised access, GoConnect cannot guarantee the security of any information you transmit to or receive from GoConnect. These activities are conducted at your own risk.
GoConnect will destroy or permanently de-identify personal information we no longer need.
5. How to access, correct or update your information:
If you ask, we will tell you what personal information we hold about you, and what we do with it. We will facilitate access to you by allowing an inspection of your personal information in person, or by providing copies or a summary of relevant documents, depending on what is most appropriate in the circumstances, following receipt of your request. Any charge we make for providing access will be reasonable.
If you can show us that the personal information is inaccurate, we will take reasonable steps to correct it. Note that we need not provide access to personal information in several types of situations, for example where a request is frivolous, or where to provide access would pose a threat to health or public safety, unreasonably interfere with another person's privacy, or be a breach of the law. If we refuse access, we will advise you of our reasons for doing so.
The credit card information provided to GoConnect when you purchase a Software Key subscription process is used only to process your credit card payment and to send verification of this payment and your account details to the email address provided. As such, you cannot access, correct or update that information supplied to GoConnect. When you are prompted to renew your subscription at the end of either 3 months or 12 months, you will be asked to re-enter your credit card details.
6. Cookies
When you visit our website, details may be recorded about your visit, such as time and date, your server address, pages accessed, time spent and type of browser. This information is used in an anonymous form for statistical purposes and as such cannot identify you individually.
We may use cookies to identify your browser so that next time you visit our website we remember your log-in details. A cookie is a small file which remains on your computer and contains information enabling our website to recognise your browser. If you do not wish to use cookies, you can adjust the settings on your browser to reject cookies or notify you when they are being used.
7. Sending data overseas and third party website
We will not send any personal information about you overseas unless you consent to this, or we reasonably believe that the other country has privacy laws substantially similar to our own, or we provide the information in other circumstances giving like protection.
Our website may contain a number of links to other websites. If this is the case, be sure to check the privacy policy of those websites as we are not responsible for privacy practices of those other parties.
8. Complaints resolution
If at any time you have any complaints in relation to privacy, please contact our Privacy Officer at one of the points referred to below. We will seek to address any concerns that you have through our complaints handling processes, but if you wish to take matters further you may refer your concerns to the Office of the Federal Privacy Commissioner.
9. What else you should know about privacy:
Remember to close your browser when you have finished your user session. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe. You as an individual are responsible for the security of and access to your own computer.
Please be aware that whenever you voluntarily disclose personal information over the Internet, this information can be potentially collected and used by others. In short, if you post personal information in publicly accessible online forums, you may receive unsolicited messages from other parties in return.
